Decide who should win this case and why:
Defendant: Mark
Other guy: Tristan
Tristan's claim: Mark was walking along with me and we were talking about his girlfriend who cheated on him. He was really mad, and I was making jokes, he joked that he would stab me, and then he did! In the arm with a pocketknife! I was just rushed off to the hospital. Shouldn't he get arressted for stabbing me?
Mark's claim: I was walking along with Tristan, really mad at my girlfriend for cheating on me, and I said "Okay, if you say that one more time, I swear TO GOD I WILL STAB YOU WITH THIS POCKETKNIFE!" Then Tristan deliberately said something about my girlfreind, and I stabbed him. It wasn't sharp, and he deserved it. He knew that I was going to stab him, but he didn't take me seriously. It's not my fault because I warned him before, when he had a chance to stop me or go away, and all he did was egg me on so I stabbed him. And I agree, it's not moral, but I wasn't stabbing to kill, and he asked me to do it.

And also, about my post, if you have any comments about the case defense, and how either of them could have put more evidence, or any fallacies (love is a fallacy play) in my case, please post them so I know.
ReplyDeleteI think that Tristan should win because he wasn't completely in the wrong. He shouldn't have deliberately started the conversation, but he was still the one who was stabbed.
ReplyDeleteI think Tristan should win. Saying insensitive remarks is less criminal than stabbing your friend for saying them in the first place. I'm sorry, but its Mark's fault for not having any self control.
ReplyDeleteTristan should definitely win. Even if he was provoking Mark stabbing is both illegal and immoral with or without provocation
ReplyDeleteI AGREE WITH FONGO!!!!! STABBING IS WRONG!!!
ReplyDeletefor some of us josh....:)
ReplyDeleteSTABBING IS BAD CHIZ. Tristan should win even though he provoked Mark. Tristan didn't do anything wrong

ReplyDeleteMaybe Tristan should win, because of the fact that he deliberately warned Mark. Morally, Tristan did the wrong thing as he should not have lost his temper SO MUCH that he stabbed someone!
ReplyDeleteI think that Tristan should win. How was he supposed to know that Mark was kidding? Friends joke around with each other a lot. There is no reason to believe him. Honestly, would you believe your friend if they said that they would stab you if you did something again?
